An Abuja Chief Magistrate Court in Wuse Zone 6 has issued a bench warrant for the immediate arrest of controversial social media activist, Martins Otse, popularly known as VeryDarkMan (VDM).

The order, issued on Thursday by Magistrate Emmanuel Iyana, followed a criminal defamation case filed against VDM by renowned gospel singer Mercy Chinwo. The court directed the Nigeria Police Force and other law enforcement agencies to apprehend the activist and present him before the court.

Defendant’s Absence Triggers Arrest Warrant

Magistrate Iyana emphasized that the arrest order was necessitated by VDM’s failure to appear in court despite being summoned on March 5.

“The defendant was duly served and given an opportunity to present himself before this honorable court. His failure to do so leaves us with no choice but to order his immediate arrest,” Magistrate Iyana ruled.

Despite efforts by VDM’s counsel, Mr. Deji Adeyanju, to prevent the arrest, the court stood firm on its decision.

“My lord, we plead for an adjournment so that I can personally ensure my client appears before this court at the next sitting,” Adeyanju urged.

However, the magistrate rejected the plea, maintaining that the law must take its course.

Defamation Allegations Against VDM

The case against VDM stems from allegations that he made defamatory remarks about Chinwo on social media. He allegedly claimed that the singer was involved in a contractual dispute over the diversion of $345,000 linked to her former record label boss, Ezekiel Onyedikachukwu, popularly known as Eezee Tee.

Chinwo, through her legal team led by Mr. Pelumi Olajengbesi, submitted documentary evidence, including emails and payment receipts, to dispute the claims.

“These allegations are not only false but damaging to our client’s public image and professional reputation,” Olajengbesi stated.

The prosecution argued that VDM’s actions violated Section 391 of the Penal Code and Section 24 (1)(B) of the Cybercrime (Prohibition, Prevention, etc.) Act 2015.

Separate N1.1 Billion Suit Pending

In addition to the criminal case, Chinwo’s legal team has also filed a N1.1 billion civil lawsuit against VDM at the High Court of the Federal Capital Territory.

“We are seeking a court order compelling him to retract his false statements, delete the defamatory posts, and issue a public apology to our client,” Olajengbesi added.

The case is expected to proceed once VDM is apprehended and presented before the court.
